hands. >> the defendant will remain incarcerated. the court made an eloquent statement understanding the situation of the victims'. >> reporter: they claimed they had insufficient time to plan his defense and appealed. >> whenever you decide someone's guilty, we might as well get this thing over with and you lose this concept of due process. that is something that should worry all of us. >> reporter: for 10 victims, eight of whom are known and testified at trial, the virtual life sentence brings a measure of closure and justice. >> they're relieved that there -- jerry's going to prison the rest of his life and can't harm anymore children. >> the judge said to the victims directly looking down at them that he admired their courage for coming forward and shouldn't see themselves as victims but as people who had the courage to come forward.

>> reporter: f jurors who convicted him, two were on hand for the sentenceing, a small measure of pride for having done their duty. >> we did what we had to do and made the right decision. he's put away and children in this area are safe. it's all good, you know. >> you feel good about your role in this? >> yes. >> reporter: coming up at the bottom of the hour, we'll take you live to pennsylvania for more insight into the sentenceing today and that is coming your way at 5:30. another big story. former d.c. council chairman kwame brown has an overnight you can few. a federal judge lashed out at him for missing three court- appointed pretrial check-ins. matt, what do you have -- did he well is have to say? >> not much. the judge had something to say. he waved his finger at the former chairman, scolding him for not checking in with court officials three times and as brown tried to explain why, the judge didn't want to hear it

and issued stricter rules. the former chairman of the council, kwame brown, was greeted by reporters and photographers as he walked into the federal courthouse and, again, as he left. brown seemed surprised by all of the attention. >> can you see anything? >> i can't say any. all of the here that is disturbing. >> reporter: but the judge was disturbed, he wanted to know why his presentencing orders were not being followed. what do you have to say about your conduct, he asked. brown apologized for wasting the court's time. he knew the importance of calling in. when brown offered reason yes he didn't think he was violating the rules, he was scolded and ordered him to check in with court officials in person each week, no longer by phone and then added an

overnight curfew from 11:00 p.m. to 6 in the morning. >> there is nothing i can say. >> reporter: few words outside of court from brown's attorney. brown is just about a month away from being sentenced for bank fraud. cook thinks his client understands what to do before then. >> i think he has an understanding what is in front of him -- he'll be fine. >> reporter: brown thought he was meeting his required contacts with court officials because he was talking with them about other issues. remember, the judge will decide brown's fate during his sentenceing hearing next month. he told brown that he didn't want to see him back in court until then and judge leon said there would no longer be a three-strike rule here but next time it would be one and told brown not to tempt fate.

shawn? >> thank you. maryland lawmaker plead guilty to misconduct in office. delegate tiffany alston paid an employee $800 with state money. she was accused of theft and using state funds to pay wedding expenses. the deal means show will serve three years probation and 300 hours of community service and has to pay $800 back to the state. tonight, a major poll showed mitt romney pulling into the lead in the white house. in a week of high-profile e vents, he's beating president obama by four points in the pugh research poll this morning. tom fitzgerald has been looking at the poll. some of the folks who put it together. how much are those new poll results affected by last week's debate? >> reporter: you can't underestimate it, will. we spoke with the directorate the pugh research center and he said clearly the impact of last week's debate is having a big impact on the poll numbers and romney's new lead over the

president. the new poll out shows the thapresident obama is trailing mitt romney 49-45% and that is romney's first big lead and the margin of error was covered by this and since he won the republican nomination in august and as recently as last month. romney was trailing the president. and romney is looking ahead and looking to build on the lead. the associate director of the p gushing h research center told us the result shows the president is slipping with key groups since last week's debate while romney is making strong gains, especially among women, latino, and independent voters. >> the trajectory of the race appears to have changeed dramatically in the wake of the debate. we saw obama with small to significant large leads throughout the campaign, throughout most of the campaign. steady leads and that

. california set a state record for gas prices. the hikes might be slowing a bit. today's average for a gallon of

regular, $4.67. the price jumped only a fraction of the cent overnight, compared to 50-cents in the past week. industry experts blame the industry costs, here it is ojaier demand, california's strict standards that don't allow for gas to cross state lines and refinery outages, which led to a decreased supply. the good news, we don't have it as bad as california. prices in our area are still well above what they should be for this time of the year. according to aaa, the national average, $3.82. in d.c., a gallon of regular will run $3.89 and in maryland, $3.70; in virginiava, $3.60. john townsend, the manager of government&affairs joins us. it's always great to see you. thanks for coming in. >> great seeing you, shawn. >> reporter: the summer driving season is over. replaced and the price of crude is down. why aren't we seeing the prices drop in the northeast like the rest of the country? >> you summed it up nicely, shawn. one reason for this is the

unfoe seen shortages in terms of the refineries are not at full capacity or haven't made the full transition to making the winter blends from the summer blends. >> oh,. >> and there is some glitches. you're seeing a spike in prices for both coasts and for seven weeks in a row, we have had prices increasing day over day over day and we have never seen anything like this this time of the year. the most expensive august on record. >> tell me about it. cost me $85 to fill up my truck and we're talking about the coasts seeing the problems and the refiners are along the coast line y. is it taking long for the lower prices to trickle out to us? >> well, one reason is the capacity problem and short supplies and that is going back

. former penn state assistant coach jerry sandusky will spend 30 years in prison. the sentence handed down after he was convicted of 45 counts of child sex abuse. bruce gordon joins us live from outside of the courthouse in bell font, pennsylvania. bruce, sandusky who is 60 years old affectively gets a life sentence here, right? >> reporter: that's right. the judge in this case made clear that he had no interest in sending a message of any kind by sentenceing sandusky to a century or more behind bars, though. technically, he could have with all those is convicts. instead, he looked at the age of the convicted child molester and gave him enough time, the 30-year minimum to make sure he dies in prison. >> he still said he is innocent and i am told me gave a long rambling statement. >> and that is right he maiains the innocence to the bitter end and is the victim of a conspiracy but involves the

university, his accusers, the media, prosecutors -- everyone can you think of is part of the vast conspiracy to do him in. he showed the only emotion of the morning when he was talking about how this whole thing had impacted him. how the lies had impacted his life and tore his life a part. about a 15-minute speech to the judge who looked unmoved by any of it and looked like a stern look on his face and offered no reaction whatsoever. but spoke to the sentence. >> and the victim statements recalling the trauma from his crimes. they were at today's sentenceing, right? they were, will, yeah. interesting, i mentioned sandusky's e holding -- emotions. no emotion of any kind shown when three young men who were young boys at the time of their abuse at the hands of sandusky, described the agony of having their childhood stolen from them. one looked him in the eye and said i don't forgive you for what you did. it was -- it was really a gut- wrenching time but no reaction

or emotion from sandusky during the period of time at all. >> they were called the agony but, bruce, is there any sense of healing from the victims? >> generally speaking, and we have talked to the attorneys for several of the victims this afternoon. generally speaking, they seem satisfied with the sentence and there is a sense they would have liked a few more years and they seem satisfied with the de facto life sentence and try to get on with their lives and that is going to be difficult. it was tough for those who got up and spoke this morning, but they're doing what they can to put their highways together. >> good insight, bruce gordon live from belfont, pennsylvania, thank you. a prince georges county sheriff's deputy accused of raping an inmate last summer is facing a $15 million lawsuit. lamar mcintire is under indictment. when questioned, he admitted his involvement.

paul wagner has more. >> reporter: he is accused of taking a 34-year-old woman into a courthouse holding cell last june where she was raped and forced to perform a sex act. the attorney is adding now details claim negligent lawsuit, the deputy sheriff took pictures of her naked inside the cell. on june 19th of this year, precious reefs was locked up on a theft charge and scheduled to go before a judge in this upper marlboro courthouse. according to police, she was escorted to a holding cell during a courtroom break where she was ordered to disrobe by a uniformed deputy. although fox 5 generally doesn't identify sex assault victims, through her attorney, she decided if to go public with the story and claiming that the deputy took breaks during the assault to attend to his job. >> his walkee talky went off he told her stay naked, i'll be right back and places his clothes on his -- pulled his pants up and goes outside of

the cell, comes back and begins to have sex with her again. >> reporter: she felt she had no chose but to do what he said. >> she didn't see another guard. all she heard was someone calling him on the radio. he told her not to put her clothing back on and she'll be back -- he would be back. >> reporter: he was armed with a handgun when he escorted her into a holding cell, which was out of sight of the courthouse surveillance cameras and he started making comments toward her about her abilities, things you would hear in a rated x movie. >> reporter: online court records she she remained locked up in county jail until mid- august. deputy mcintyre was released on the $50,000 bond. he was suspended without pay from his job from the sheriff's office and is facing a trial on rape and sex assault charges. the civil lawsuit names the deputy and the state of

maryland as defends. reefd to go -- reefs decided to go public with her story and hopes it helps others. >> thank you. defense lawyers lost their fight to block a medical expert from testifying in a month groomery county murder case. curtis lopez is accused of killing his estranged wife and her 11-year-old son last year. the boy was beaten with a baseball bat and his body later found in a wooded area. the medical examiner will testify about the of the boy's skull. the defense protested because their experts have not seen the child's skull. a murder officially ruled. sarah green hall was killed in july. her body was found in a burning upperville home. a medical examiner ruled she was shot in the neck. no one has been arrested at this point. she works for the winchester star. a meningitis outbreak that sickened peekpeople in several states is growing in virginia now. coming up, find out where health officials say the majority of cases are being

. virginia health officials say there are 24 reported cases of suspected fungal meningitis in the state. one deadly. the saintd -- tainted steroids product linked to the illnesses and went to two medical facilities in virginia. one in roanoke, the other in christianburg. altogether -- all together, they contacted more than 630 patients about possible exposure between july and september of this year. product is no longer being used. a new study is likely to add to the confusion over mercury exposure from sea food during the pregnancy. it said that low levels of mercury can increase the chances of adhd symptoms showing up in a child.

pattern. it's not normal for us. it doesn't take much this time of the year to cool us down and lock us into the cloudy, cool pattern. so, what is going? basically, a bit of a transfer of -- a trough in the northeastern section of the united states and that will undoubtedly bring the cool air in and what has happened the last few days, believe it or not, we have been under the high pressure and with this notice around, the counterclockwise flow keeps coming up along the stationary boundary off to the east of us and we kind of lock in this cool breeze. from time to time we have a shower coming through and that is on the cool side. overnight tonight, we're going to so this again and we may end up getting a little bit of drizzle and some fog persistent out there and we may wake up to that tomorrow morning. i don't think that is going to be for everybody. i think that the best risk of this will be east-southeast of the metro. if you're in the western- northwestern neighborhoods, while i think you will end up

with clouds, i don't think that we'll end up waking up with a lot of drizzle or fog. it's 61 now, we had enough sunshine, just a little bit, helping warm us into the lower 60s. some places into the 50s and not to low, continuing with mostly cloudy conditions and that is looking like fog and drizzle and that is going to be overnight. persistent clouds, west of the mountains. things open up and they're brighter. offshore is where most of the rain has been and this is along the shore for jersey, parts of delaware, and even parts of, at least some secs of maryland. most of this is staying east the of the bay and, again, back to the west. and where the -- underneath the high pressure, nice and sin, the frontal system is coming
